brian. downed power lines, toppled trees, all the work of gusting winds overnight. people in much of the bay area and beyond are waking up to wind damage. kpix 5 reporter kate kogarrett is live where a homeowner hurt after a tree came crashing down. how are you? what's the latest? >> reporter: calm. know a lot of cleanup work needs to be done. hopefully seen the worst of it. know some winds are still lingering around the bay area. as mentioned, a family in ant i don't care in this home did get an unwelcome surprise. take a look for yourself. the winds were so strong, it knocked this tree branch straight through this person's home. sharp branches came through the roof, stopping inches from the bed. the homeowner was hurt, was taken to a local hospital. no word on his condition. take a look at this. the high winds over there flipped over six trucks and a brand-new travel trailer.

trucks along 580 were veer from side to side. drivers told they had a rough time navigating those roads. >> does. that's the big issue people are talking about. looking like they're driving into fog. >> and this picture was taken in emeryville. strong gusts took down the passat of the nike store. fell off the building on to the street a. couple cars were damaged. thankfully no one was hurt. also know that downed power lines left a lot of people in the dark. actually nearly 18,000 customers were without power. learning now that pg, e working to restore power to some of those homes. reporting live, kpix 5. it was a nursing home with a big complaint. most of the staff left leaving behind more than a dozen patients. mark kelly in castro valley with the problems found at the troubled facility. mark? >> reporter: michelle this is

the valley manor, residential care center. the state shut it down thursday, but allegedly patients still living inside with very little care. now a peek inside valley manor. it's here that owner emanuel reportedly disappeared, left a small staff to care for more than a dozen disabled patients. as required by law, attorney says there were two caregivers and a cook taking care of 14 patients. but as the report cites violations including feces and urine in the facilities, insufficient food for patients. one neighbor tells she's been concerned for years. >> hopefully people will have their eyes open open. >> reporter: the owner's attorney says his client has a heart of gold. she was caring, he says, for elderly patients on a fixed income when, michelle, she got sick herself.

>> reporter: how are the patients doing? . >> at this time, the patients have been moved to either another facility or in with. said to be doing okay. >> mark kelly live. unions will vote on a tentative contract agreement this week. the deal struck last week ended bart's second strike this year. push now to stop mass transit strikes from ever happening again in california. the idea gaining momentum. there's fear lawmakers in sacramento will not go against labor unions. experts say the best bet to stop these strikes will be a voter initiative. ma rain county jurors will hear from prosecutors and guy if i yearry this week in the trial of max wade. 19-year-old accused of stealing if i yearry's $200,000 lamb boar againny two years ago. he's also on trial for the attempted murders of a classmate he was infatuated

outgoing -- deborah is recommending that escovel have the job on a permanent basis. the veteran took over for retired chief chris moore back in january. officers have been leaving the department since the city's financial struggles prompted cutbacks, wages, benefits. new criticism of the troubled web site for the health care reform program. the head of the jones committee claims the site may leave users vulnerable to identity theft, other cyber crimes. >> they do not have an overarching solid plan to prevent the loss of private information. they may have to redesign the entire system. the way the system is designed, it is not secure. >> reporter: health and human services secretary kathleen is a deal use says the site does not retain or store user information. it's been nearly a year since new york's historic ellis island was closed because of hurricane sandy.

>> and reporter jareka down can said the island is reopening to tourists about an hour from now. >> reporter: for the first time in a year, parts of ellis island are back open to the public. starting this morning, tourists can once again travel by boat to the historic island known for welcoming millions of immigrants into the united states. this group of women from europe visited the statue of liberty sunday, plans to visit ellis island today. >> must have been emotional, must have been scary, exciting. would just like to see it. . >> reporter: a year ago super storm sandy swamped the island with 8 feet of water. the storm destroyed broilers, electrical systems. the water washed through the immigration museum. crews moved more than 1 million photographs and arty facts in maryland. the national park service, which runs ellis island said they're still restoring the properties; but for

the earlier accident has been cleared up. no accidents. an early start to that commute. an accident along southbound 101 has been cleared up. all lanes open as you approach 92. sensors picking up light traffic for both 101, 280 heading through peninsula. if you plan on driving along the nimitz to catch a flight, 880 a great option with no delays. the silicon valley commutes have been fine. didn't have construction overnight. all lanes open. for 101 making that commute approaching the 280 interchange. the 882-237 interchange, which normally gets busy around 7 in the morning. looking good with no big delays. first bart trains are out of the yard on time. no delays reported for cal train. no problems for 101 heading across the golden gate. a look at kcbs traffic.

drunk driver this morning. this is a live look at the scene. happened about 2:30 a.m. on the city's west side. the 27-year-old female driver was arrested on suspicion of driving under the influence, vehicular manslaughter. the car also hit a garage door on a house. happening now, waking up to damage by an overnight wind storm. strong, gusting winds overturned trucks, brought down trees, left thousands without power. caso is in ant i don't care where the storm left one person hurt. >> reporter: the family who lives in this house has cleaning up to do after this. take a look at this video. the winds were so strong it knocked this tree branch straight through this person's home over the weekend. the branch broke through the roof, stopping inches from the bed. the homeowner was hurt, taken to a local hospital.

where westbound 580 is fine heading down. the bridge commutes looking okay. a brief delay at the bane bridge toll plaza. chp telling they had canceled the advisories. that's good news. westbound traffic continues light across the span heading into the city. southbound 680 looking good, leaving pleasanton headed for the fremont area. no delays reported for ferry systems, caltrans or commute express. more than a dozen people rescued from a nursing home in the east bay. the patients were abandoned last week after the state suspended the home's license. mark kelly with the latest on the problems found at the troubled facility. good morning. >> reporter: this is the valley manor residential care center. the state shut it down thursday, but allegedly patients still living in it with very little care.

this morning, a response from the owner's attorney. here's a look inside valley manor. here the owner hild emanuel reportedly disappeared, left a staff to care for more than a dozen patients. a report cites violations, including feces, urine in the facility, insufficient food for patients. a woman living nearby has been concerned about this facility for some time. >> the staff isn't -- >> reporter: asked the owner's attorney. he says, as required by law, there were two care givers and a cook taking care of 14 patients; but he says there's been no stop signs from the state when valley manor shut down. >> nobody has been abandoning anybody. you're in a catch 22 situation. you can't take care of the people. you're supposed to transfer them. but there's no resources to transfer them. >> the state report slaps a laundry list of violations on this facility,

requesting its owner never own, work, be associated the facility ever again. >> the owner's attorney says his client has a heart of gold. she was caring for elderly patients on a fixed income, he says, when she got sick herself. live in castro valley, mark kelly. >> by the way, the patients were moved either to other facilities or back. managers could be facing elder abuse and other charges. in headlines around the bay, a suspect is in critical condition after he was shot by san francisco police officers. police say he got into a fight with another man yesterday afternoon in the marina district. the suspect allegedly fired at the victim several times before running away. officers caught up with the shooter a few blocks away. police say they shot the suspect after he pointed a gun at them. no word on the victim's condition. he also fled the scene. a 19-year-old was killed and as many as 7 others

injured after a shooting saturday night. police say a group of teens heading to a party stopped on princeton avenue to fix a flat tire. minutes later, someone in a white suv pulled up, fired multiple shots before driving away. no word yet on a motive. a city taking the lead on gun control with a safety measure on the november ballot. as don kna,p tells us, measure c pro vehicling worry among gun rights advocates. >> how about if you go there? and i'm going to going to hit that. >> you'll do henderson. >> cheryl weiss, campaigning for a gun safety law for sunny vale. >> hello. >> are you familiar with measure c? >> reporter: promoters say it does just a few things to improve gun safety. requires owners to report lost or stolen guns within 48 hours, keep them locked up, disabled, with

trigger guards, advance magazines and requires dealers to record sales. >> really the spur for all of this. >> reporter: the sandy hook elementary school shooting spree that took the lives of 20 first graders, six adults. for this community of 140,000 it's a think national act local campaign promoted by the mayor, a retired fire captain. >> hear every day, young adults finding weapons in their homes, going somewhere, to another school. past week, had two shootings at schools that involved teachers, stuff like that. has to stop. >> reporter: the city council put the measure on the ballot. private donations funded a single mailing. volunteers do all the rest. >> public school teachers have been killed this past week. some go -- i had a student who picked up a gun lying around, killed his sister. >> reporter: but gun measures, gun safety measures worry advocates. >> there's the fear the whole slippery slope, once you start giving ground you'll lose more than

two smartphone, the 5c, 5s. toyota is the world's top- selling auto maker so far this year turns out. it has out sold general motors for the first months of 2013. toyota announced it sold 7.4 million vehicles between january, september. a new survey out from the associated press. it finds 9 in 10 workers say they're very or somewhat say the with their jobs. that highlights similar research done showing job satisfaction rises with age. not sure if people get wiser when they're older, give up hoping for better, either way. >> can't speak from personal experience. get there, let you know. at the same time, first job was as a bun warmer as the gill roy, mcdonald's. i'm always keen to know what the latest changes are.
